NudgeGift expressly excludes any representation or warranty, express or implied, with respect to the information available on this Website. NudgeGift makes no representation about any third-party websites that may be accessed via links from this Website. By using this Website, you agree that the law of the State of New York, without regard to its conflict of laws principles, will govern all matters between you and NudgeGift with respect to your use of this Website.
You explicitly agree that the use of our service is on an ‘as is’ basis. NudgeGift does not guarantee it’s partners or it’s partner’s services and products. We wish we could, but that would be impossible. We also do not guarantee our carrier. They are a way bigger company than us and would laugh at us if we tried to make them guarantee anything. There is no warranty that the NudgeGift services will be timely, secure, without error or uninterrupted. We can only do our best but some of this is out of our hands. NudgeGift will provide the Services to you upon successful registration. If you lose your code that we text you, first check your email. We send via SMS as well as email. We are not responsible for lost codes.
NudgeGift reserves the right to cancel any order and refuse service at our discretion.
Prices of our products are subject to change without notice, as is our products, partners and any other content on the NudgeGift site. Our deals are always changing. You snooze, you lose. There is never any cash back on anything we sell and the certificates can never be redeemed for cash. All sales are final. There are no refunds or returns. We are not responsible for our partners that go out of business or change locations. You must always use the full amount of the gift certificate in one visit, or you lose the remaining value.
You must abide by the limits each NudgeGift partner sets. If you have any questions about a specific deal on our site, contact that particular business.
Stealing and Fraud: Both of these things are bad. Don’t do them to our partners, don’t do them to us.
You will be giving us your private information. We have the right to collect and use this information in connection with the Services we provide. NudgeGift reserves the right to suspend or terminate your account at any time, without notice. Some of the reasons for this action may include 1) giving false information (phone number, credit card, name) 2) we receive information that the credit card you use is stolen 3) You order erroneously or try to use your text more than once 4) You credit card is rejected 5) You yelled at your mom and did not apologize. NudgeGift is not liable to you for any termination of this agreement and you agree to pay any money owed at the time of termination.
In the event a product or service is listed at an incorrect price due to a typographical error or error in pricing information received from a supplier, we shall have the right to refuse or cancel any order placed for such product or service at the incorrect price, even if the order has been confirmed and/or your credit card has been charged. We will credit your account and notify you in a timely manner.
